GAEC Update: FDA Allergen Labeling Requirements
The IFSA Government Affairs & Education Committee recently had a conference call with the FDA. It was explained that all allergen labeling requirements are currently in effect.

There is not a grace period for this regulation as there is no regulatory discretion on allergens. Furthermore, it is important to know that ALL PACKAGED FOOD ITEMS are under the allergen labeling requirements.

This is effective immediately.

A packaged food item is defined by the FDA as anything a consumer has to take the top off of and/or open in order to consume. If the lid is removed before serving the item then it is not a packaged food item.

All packaged food items containing any of the 8 major allergens MUST have one of the following:

Label stating that the item "contains" the allergen(s). A "may contain" statement is not sufficient.
(or)

Listing of all ingredients which includes the common name of the allergens contained in the product. Please note that listing all ingredients may trigger additional labeling requirements.
The committee is currently working with the FDA on clarification of other labeling regulation. As we receive additional clarification we will share the information with you. For now it is very important that the allergen regulation above is in effect for everyone in the industry.

For additional information please reference:

Food Allergen Labeling and Consumer Protection Act of 2004 (Public Law 108-282, Title II)

FAQ

GAEC Reminder: USDA Regulation of Back-Catering and Removal of Regulated Garbage
Recently the IFSA Government Affairs and Education Committee met with the USDA to discuss the removal of regulated garbage aboard aircrafts and exemptions of certain food commodities, specifically when dealing with back-catering.

According to the USDA, "Unused meals and other foodstuffs carried aboard aircraft in the galley are subject to removal as garbage regulated by the United States Department of Agriculture, Animal and Plant Health Inspection Service (APHIS)."  -Title 7 Code of Federal Regulations §330.400-§330.403 and Title 9 Code of Federal Regulations §94.5.

Certain commodities are exempt from these regulations and are allowed to remain onboard; however, they are NOT to be comingled/contaminated with APHIS regulated garbage.

For a specific list of which commodities are exempted, please reference the following regulation:

Foodstuffs Onboard Aircraft Exempted From Removal as Regulated Garbage¹

Be advised: If the foodstuffs and beverages listed are contaminated with APHIS regulated garbage, then they are regulated.
